25 years ago the Americans with Disabilities Act became law. In a number of ways this act has touched more people than the civil rights laws of the past. All the handicapped parking places, the larges bathroom stalls, the ramps, the cut outs in side walks, the bathroom signs and the braille in places like elevators all comes from the ADA.

It has had a positive effect on the disabled, it has also has an effect of all of us. Elevators and ramps exist where only stairs existed in the past. Large buttons that open doors exist where none did in the past. While these were mandated for wheel chairs most of us use these for our own convenience.

The range of requirements is vast. Title I of the Americans with Disabilities Act of 1990 prohibits private employers, state and local governments, employment agencies and labor unions from discriminating against qualified individuals with disabilities. The law applies to employers with 15 or more employees.

The range of disabilities may surprise you:

  • Any physical or mental impairment that limits a major life activities;
  • Deaf employees needing sign language interpretation
  • Diabetics need regularly scheduled breaks to monitor insulin levels.
  • A blind employee need braille signs
  • It covers existing facilities used by persons with disabilities.
  • It requires Job restructuring, modified work schedules, and reassignments
  • Acquiring or modifying equipment
  • Adjusting or modifying training materials and policies
  • Providing interpreters.

Employers are required to make a reasonable accommodation to the known disability of a qualified applicant or employee.

The law has not been without abuse either – employers have been fined and sued for large amounts of money for minor and relatively unknown oversights. There are actually law firms seeking out these types of suits.
