Do You Qualify for Summary Dissolution? To file for summary dissolution in California, both parties must agree to the divorce and meet all of the following criteria:
  • The marriage or domestic partnership has lasted less than 5 years
  • There are no children together, biological or adopted, during the marriage
  • Neither spouse owns any real estate, including property out of state or rental units
  • The couple’s community property is valued at under $47,000
  • Separate property is worth less than $47,000 each (excluding cars)
  • Shared debts total less than $6,000, not counting vehicle loans
  • Both parties agree to waive spousal support
  • Both parties sign a written agreement dividing property and debts
