Jill still cared deeply for Jack, her husband of nearly 10 years, but their once happy marriage had turned rocky. Like so many clients that darken my door, Jill thought only two options existed – continue struggling unhappily together or pursue a daunting divorce. Jill’s eyebrows shot up in surprise. What is legal separation and could it help struggling couples like Jill and Jack? Let’s explore this unique arrangement and its benefits in greater detail: While divorce fully terminates a marriage, legal separation allows married couples to formally separate while still remaining legally wed. The court issues an order recognizing the couple has chosen to live apart and addresses major issues like child custody, support, and division of assets and debts through the legal process. However, the marriage itself remains intact and neither spouse can remarry until an actual divorce occurs. For some couples like Jill and Jack, separation can provide much-needed breathing room - a chance to heal wounds, gain perspective, and potentially even reconnect. But is it the right choice? First, who qualifies for legal separation in California? The process is only available to couples legally married within the state. One spouse must have lived in California for 6 months and the county for 3 months before filing. Additionally, both spouses must agree to address issues civilly through the court while living apart. Either the husband or wife can initiate separation by submitting a Petition for Legal Separation along with other necessary court forms. Filing fees apply unless waived. The petition must be legally served to the other spouse, meaning someone 18 or older must personally deliver it. How is the process different from divorce? While divorce severs marital ties completely, separation leaves your union intact. You keep certain benefits like health insurance while separated but cannot remarry until a divorce is finalized. Some see the process as “test driving” permanent separation before fully divorcing. Additionally, we outlined a shared parenting schedule minimizing disruption for their son. With these critical pillars in place, Jill moved forward feeling far more confident and in control. After finalizing the separation, Jack moved nearby so they could effectively co-parent their son. A year later, their amicable separation enabled a smooth transition into finalizing divorce when Jill felt ready for closure. While still painful, the process provided Jill time and space to get clarity about ending her marriage.
