After a lawsuit is filed, the case ordinarily gets sent out to mediation prior to trial. I strongly communicate to the mediator what I believe is the fair value of a particular case. Once I present a strong showing to the mediator, the mediator will speak to the opposing side and attempt to convince them of the value that I determined the case to be worth. If the opposing side does not agree, or is unreasonable with any offer, then my client and I move forward and get our “day in court” before a jury.
