July of 2020—U.S. Food and Drug Administration released alert letters notifying ten firms, including Cool Clouds Distribution Inc. (doing business as Puff Bar), of withdrawing their flavored disposable e-cigarettes and youth-appealing e-liquid items from the market because they do not have the requisite pre-market authorization. These recent actions are part of the continuing aggressive campaign by the FDA to address illegally marketed tobacco products in the light of the public health epidemic of youth e-cigarette use in America. The Agency is especially concerned about the attractiveness of flavored, disposable e-cigarettes to young people and continues to track all available data.

The Puff Bar website, which is believed to be run by Cool Clouds Distribution, reported last week that it had “ceased all online sales & distribution in the U.S. until further notice,” so the FDA action is possibly meaningless. Puff Bar mogul is likely to move on to selling similar goods with different brandings.

Puff Bar was introduced last year and became popular mainly because JUUL had voluntarily withdrawn its non-tobacco and menthol flavors from the market in November 2018. A year later, in January 2020, the latest FDA rules banned all pod and cartridge-based vaping products from being marketed in flavors other than tobacco and menthol, except disposable products.

It was after the FDA guidelines were released in January that the news media became aware of Puff Bar, informed by the Tobacco-Free Kids Movement and other tobacco control organizations that reported that Puff Bars and other newly launched disposable items had been exempted from FDA compliance.

That’s never been real. Although the Guidelines exempted disposable e-cigarettes, the exemption only applied to products that existed on the market prior to the date of August 8, 2016, as set out in the FDA Deeming Law. No product may be launched after that date without first submitting a Premarket Tobacco Application (PMTA) and obtaining marketing approval from the FDA, which Puff Bar vendors definitely did not do.

However, starting at the end of January — and rising after the FDA had taken effect at the beginning of February — dozens of reports appeared in major news outlets that reported otherwise. Most used Tobacco-Free Kids Campaign President Matthew Myers, or another member of his Bloomberg-funded tobacco control cabal, as their “expert” source.

Some of the well-known reporters who wrote about the “Puff Bar Lack” included Sheila Kaplan of the New York Times, Matthew Perrone of Associated Press, Laurie McGinley of the Washington Post, and Allison Aubrey of the NPR. (Perrone, in an article published today on the warning letter, reiterates his earlier statement that ‘the prohibitions on flavoring did not extend to disposable steaming items such as Puff Bar.’)

Both of these articles quoted Myers’ argument that the FDA guidance offered a free pass to Puff Bar and similar products, and his argument that only a federal ban on all flavored vaping products would bring an end to the “epidemic” of teen vaping. None of the reporters in question took the time to ask the FDA whether the “loophole” referred to goods that were already on the market illegally.

As it turned out, the FDA warning letter to Puff Bar is focused on the goods that are being launched without first obtaining the requisite marketing approval via the PMTA process. There is clearly no FDA guidance void to shield an already unlawful substance from being enforced by the Department.
