Much remains uncertain regarding the iconic disposable e-cigarette that was “quickly becoming the new JUUL,” including whether the products are still on sale in the U.S. and who owns and runs the business.
Puff Bar, which mimics the famous JUUL, comes in many young-looking flavors such as O.M.G. (Orange, Mango, Guava), but is not subject to a partial ban on flavored e-cigarettes since it is a disposable product. The regulation gap – which came into effect in January and restricts the flavors of closed-system e-liquid cartridges, such as JUUL and its pods – paved the way for a spike in the popularity of the product. Data from the first-of-its-kind youth quit-vaping program This is Quitting, a free and anonymous text message program from the Truth Initiative, showed that by March 2020, the majority of young people participating in This Is Quitting no longer reported using JUUL. Many recorded the use of disposable products, and Puff Bar was the most common disposable brand.
Recent news reports have identified a complete lack of clarity on who makes and distributes Puff Bar.
Fair Warning, a research news source, took a deep dive to try to find out more about the venture. In an interview with two people listed as the CEO and CFO in a document filed with the California Secretary of State, they all stated no ownership and said they were just operating the Puff Bar website. Neither will they say who recruited them. The investigation also reported that Puff Bar “appears to be intertwined with many other businesses in the U.S. and China.” One such company is Cool Clouds Distribution, Inc., which Bloomberg reported working out of an unmarked building in Los Angeles’ Skid Row in February.
Puff Bar should never have been sold because it is illegal to sell any tobacco product that was not on the market before August 2016. Still, Puff Bar emerged on the market in 2019 and profited until the Food and Drug Administration took regulatory action.
At the end of July, the FDA sent a letter asking the Puff Bar to withdraw all flavored e-cigarettes and youth-appealing flavors from the market. While the Puff Bar website notes that all online sales and distribution in the U.S. have now stopped, Puff Bar products can still be found on e-commerce sites such as Eliquidstop (owned by the same two people known as Puff Bar CEO and CFO) according to the tobacco industry trade publication Tobacco Reporter.
A variety of copycat and knock-off Puff Bar products have appeared on the market, confounding consumers. In reality, Puff Bar also started printing codes on their system packaging to allow users to authenticate the products via the official Puff Bar website.
