Litigation is in essence a “lawsuit.” Litigation is a means for handling any dispute through the courts. A party to a lawsuit can be an individual, a corporation, or an “entity” like a homeowners’ association or government agency. All parties involved in a lawsuit are called litigants. During the litigation process someone else, like a judge, may make the final decisions for the parties unless the parties settle before a trial. Settlement can occur at any point during the legal process (which is why we try to mediate or negotiate first). During the litigation process, there may be a series of hearings or temporary orders culminating in final orders. Final orders regarding the real issues in the case are usually entered only after there has been a trial with key witnesses. A trial can get costly. It can also be messy. But in some cases it is the only way to come to a resolution over a dispute that could work out otherwise via negotiation or mediation. In these cases, ZinnLaw is here to help you.
