Hello, everyone. My name is Aaron Hichman with Brignole and Ghiri Insurance. We are a full line Property and Casualty Insurance Agency based out of Oakland, California, and serving the bay area since 1925.

I want to talk to you about Employment Practices Liability Insurance, or in other words, EPLI. What is Employment Practices Liability Insurance? That’s when an employee sues an employer for inappropriate workplace conduct like wrongful termination, discrimination, sexual harassment, defamation, invasion of privacy, failure to promote, deprivation of a career opportunity, and other inappropriate workplace conduct. Also know, Employment Practices Liability Insurance claims are not covered under your General Liability Policy. With that said, if you do add Employment Practices Liability Insurance to your General Liability Policy policy, the coverages are limited and not enough to protect your business. Another part of the Employment Practices Liability Insurance policy you want to make sure you have is Third-Party Employment Practices Liability Coverage. What does is the cover? This part of the policy covers you if your employee discriminates against a customer. Most EPLI policies do not have this coverage, but it is essential coverage to have.
Brignole and Ghiri Insurance has an EPLI Program through the IIABCal. Program Details:
The insurer is Houston Casualty Company.
Full Prior Acts Coverage included, the policy insures the entity and all employees, including part-time, temporary, leased (by endorsement), seasonal, and independent contractors (by endorsement).

A broad definition of employees
The policy includes a broad definition of harassment that also includes electronic harassment.
Up to three years of ERP options built into the form
The EPLI program also includes a full complement of risk management services provided by HR Pilot.
HR Pilot includes SB1343 – sexual harassment training – required by the State of California if the employer has five or more employees. 1 hr for managers and 2 hrs for employees
If eligible, Wage & Hour, Wage & Hour Coverages $100,000 sublimit.
The program has three different coverage limits you can purchase. 250K, 500K, and 1 million. The deductible is $5,000 with business less than 75 employees and not located in Los Angeles, Orange, or San Francisco County; then the deductible is $15,000.
