Because of a new law that has cannabis businesses worried, the US Postal Service will no longer be able to ship vaping products starting this summer. When Congress passed an appropriations bill to keep the government running in late December, lawmakers also included the text of a separate bill. The USPS is prohibited from shipping vaping products under the “Preventing Online Sales of E-Cigarettes to Children Act.” The law goes into effect in late March, and the USPS has 120 days to develop rules to implement it. FedEx and UPS have already stated that they will not ship vaping products in accordance with the USPS directive.

According to Matthew O’Connor, a UPS spokesman, “effective April 5, 2021, UPS will not transport vaping products to, from, or within the United States due to the increased complexity of shipping those products.”

There is currently no publicly available information on how frequently vaping products are mailed. According to Rick Maturo, associate client director for the Nielsen Cannabis Insights Practice, U.S. consumers ordered $44 million in CBD vape cartridges online in 2020, providing some indication of how often mail carriers might be used to fulfill orders.

According to the new rules, vaping product sellers must do the following:

  • Ship with a private company like DHL, which requires a signature upon delivery.
  • Register with the United States Attorney’s Office.
  • Set up a system to verify your age.

The new restrictions are “another attempt by the government to ‘demonize’ nicotine vaping,” according to Arnaud Dumas de Rauly, CEO and co-founder of The Blinc Group, a New York company that develops and supplies cannabis vaping hardware. He expressed confidence, however, that lawmakers will not target cannabis.

“The most important concept in this part of the bill is its intent, which is to restrict nicotine vaping rather than cannabis,” Dumas de Rauly explained.
